Terms of participation

In short

Participation is free. Smile Unlocked makes an editorial decision about which stories to pursue. Submission creates no entitlement to selection, fulfilment, publication, payment or a cash alternative.

1. Organiser and scope

The organiser is C&I Business 5.0 GmbH, Aachener Straße 37–39, 50674 Cologne, Germany (“Smile Unlocked”). These terms apply to wishes, nominations and ideas submitted through the website. Smile Unlocked is not a prize draw, lottery, gambling or donation programme.

2. Free participation and no entitlement

Submission is free and not conditional on a purchase, payment or social-media activity. There is no entitlement to review within a set time, selection, contact, fulfilment, any particular scope or value, publication or cash payment. Submission does not create a contract to fulfil a wish.

3. Age

A person may submit from age 13. A submission by a 13–15-year-old is considered only after confirmation by a parent or legal guardian. A 16- or 17-year-old may submit independently, but separate written guardian consent is required before any fulfilment, travel, recording or publication. Children under 13 may not submit themselves but may be nominated by an adult.

4. Submissions and nominations

Information must be true to the best of the submitting person’s knowledge, respectful and understandable. For a nomination, that person must reasonably believe that the nominee would accept confidential contact. A surprise does not justify deception, danger or invasion of privacy.

No health information, religious beliefs, sexual orientation, criminal allegations or similarly sensitive facts about another person may be submitted without their express agreement. Third-party contact details may be supplied only where necessary and lawful.

5. Selection and contact

Smile Unlocked selects stories editorially and may consider organisational, safety, legal, content and economic factors. Partners may offer fulfilment opportunities, but editorial selection remains with Smile Unlocked. We may stop reviewing or planning at any time, particularly where consent, rights, safety, funding or feasibility are not assured.

6. Uploaded content and rights

Anyone uploading photos, videos or other content confirms that they are entitled to do so and respect third-party rights. Recognisable third parties may appear only with their permission. The upload grants Smile Unlocked a non-exclusive, royalty-free right limited to internal review, technical storage and selection. It does not cover publication, advertising, disclosure to partners or production editing.

For a selected story, separate releases covering image, personality and usage rights will be agreed before recording or publication. Uploaded material is not made public solely under these terms.

7. Fulfilment and recordings

Details of any possible fulfilment – including process, participants, costs, travel, safety, partner naming and recordings – are agreed separately. Participants may decline recording. Partner support and advertising will be identified as required by law.

8. Prohibited content and exclusion

Prohibited content includes unlawful, insulting, discriminatory, threatening, pornographic or dangerous material, infringement of rights, deliberate falsehoods, manipulation, mass automated submissions and primarily self-promotional submissions. Such submissions may be excluded and deleted without further notice.

9. Liability

Smile Unlocked has unlimited liability for intent and gross negligence, injury to life, body or health, and mandatory statutory liability. For slightly negligent breach of essential duties, liability is limited to foreseeable typical damage. Liability for other slight negligence is excluded.

10. Privacy

Our privacy policy explains processing and deletion, including nominations and minors. A submission may be withdrawn before binding fulfilment by emailing hello@smile-unlocked.com.

11. Final provisions

German law applies, without removing mandatory consumer protection in the participant’s country of habitual residence. The version published at the time of submission applies. Changes apply only to future submissions unless individually agreed.

This English version is a translation. In case of discrepancies, the German version prevails to the extent permitted by law.
